Terms of Service

These Terms of Service (the "Terms") govern your use of Fluenso, an AI-powered English practice application operated by SHIFT LLC ("we," "us," or "our"). Fluenso helps non-native English speakers practice speaking and writing English through scenario-based conversations, an AI coach that highlights mistakes in real time, vocabulary building, and an onboarding flow that assesses your CEFR level. The service is accessible at https://fluenso.app.

By creating a Fluenso account or using any part of the service, you agree to these Terms. If you do not agree, please do not use Fluenso.

1. What Fluenso is

Fluenso is a subscription-based web application (also installable as a PWA). The core features are:

Practice scenarios — guided conversation drills for workplace situations (standups, code reviews, 1:1s, interviews, Slack messages, tech interviews, and more)
Real-time AI coaching — grammar, tone, and phrasing feedback generated by a large language model during each practice session
CEFR level assessment — an optional 18-question placement quiz (and a short AI conversation during onboarding) that estimates your level (A1–C2) and adapts future sessions
Vocabulary and mistake tracking — your recurring mistakes and learned vocabulary are stored in your account and surfaced for spaced-repetition practice
Progress insights — weekly session and mistake counts

Fluenso is a learning tool, not a certification body. Scores, level assessments, and feedback are estimates generated by AI; they do not constitute an official language evaluation.

2. Accounts

You need an account to use Fluenso. You may register with an email and password or sign in with Google. You are responsible for keeping your credentials secure and for all activity under your account. Notify us at support@fluenso.app if you suspect unauthorized access.

You must be at least 16 years old to use Fluenso. If you are younger, you need permission from a parent or legal guardian.

3. Subscriptions, trial, and payments

Fluenso offers a free tier and a paid Plus tier. The free tier includes a limited number of practice sessions and features; Plus unlocks advanced scenarios, unlimited sessions, mistake tracking, and CSV export.

Free trial — new users may start a free Plus trial (length displayed on the pricing page at sign-up) without providing a payment method. After the trial ends, the account returns to the free tier unless you subscribe.
Billing provider — subscriptions are processed by Monetize (our payment partner). When you purchase Plus, you are redirected to Monetize's hosted checkout, where you agree to Monetize's own payment terms.
Currency — prices are displayed in your local currency when supported (USD, BRL, EUR, RUB, MXN). You may override your currency in the Account page.
Auto-renewal — paid subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled. You may cancel at any time from the Monetize customer portal, accessible from your Fluenso Account page.
Refunds — see our Refund Policy for a 14-day money-back guarantee on new subscriptions.

We may change prices for future billing cycles. If we do, we will notify you by email at least 14 days in advance.

4. Acceptable use

When using Fluenso, you agree not to:

Share your account credentials with others or resell access
Attempt to reverse-engineer, decompile, or extract training data from the AI models
Submit content that is unlawful, harmful, harassing, or infringes on intellectual property rights
Use the service to generate bulk content for commercial resale
Use automated means (bots, scrapers) to access the service beyond what a normal user can
Circumvent rate limits, feature gates, or subscription checks

We may suspend or terminate accounts that violate these rules.

5. Content you submit

When you practice with Fluenso, your messages (typed or transcribed from voice) are sent to our AI provider so the coach can respond, correct mistakes, and track patterns. We store your chat transcripts so you can review past sessions and so the service can personalize future ones.

You retain ownership of the content you submit. By using Fluenso, you grant us a limited licence to process that content for the purpose of providing the service (AI inference, spaced-repetition scheduling, progress tracking). We do not sell your chat transcripts or use them to train external models.

You can export or delete your data at any time from Account → Delete account or by contacting support.

6. AI limitations

Fluenso relies on large language models. AI output can be inaccurate, inconsistent, or outdated. Treat grammar corrections and level assessments as guidance, not authoritative judgments. Do not rely on Fluenso for high-stakes language decisions (legal, medical, academic certifications).

7. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may add, remove, or change features, including AI models and scenario content. We will give reasonable notice for changes that materially reduce functionality you pay for. If a change meaningfully degrades a paid plan, you may request a prorated refund.

8. Termination

You may stop using Fluenso and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if your payment fails and is not resolved within 14 days, or if required by law. Upon termination we will delete your personal data within 30 days unless we are legally required to retain it.

9. Disclaimer and liability

Fluenso is provided "as is." To the maximum extent permitted by law, SHIFT LLC's total liability to you for any claim relating to the service is limited to the amount you paid for Fluenso in the 12 months preceding the claim. We are not liable for indirect or consequential damages such as lost profits, lost learning progress, or missed opportunities.
